An Act authorizing the Manumission of Negroes, Mallattoes, & others, and for the gradual Abolition of Slavery

Whereas all Men are entitled to Life, Liberty and the Pursuit of Happiness, yet the holding Mankind in a State of Slavery, as private Property, which has gradually obtained by unrestrained Custom and the Permission of the Laws, is repugnant to this Principle, and subversive of the Happiness of Mankind, the great End of all civil Governments:

Be it therefore enacted by this General Assembly, and by the Authority thereof it is Enacted, that no Person or Persons, whether Negroes, Mulattoes, or others, who shall be born within the Limits of this State, on or after the First Day of March A.D. 1784, shall be deemed or considered as Servants for Life or Slaves; and that all Servitude for Life or Slavery of Children, to be born as aforesaid, in Consequence of the Condition of their Mothers, be, and the same is hereby taken away, extinguished & forever abolished.

And whereas Humanity requires that Children declared free as aforesaid remain with their Mothers a convenient Time from and after their Birth; to enable therefore those who claim the Services of such Mothers to maintain and support such Children in a becoming Manner, it is further Enacted by the Authority aforesaid, That such Support and Maintenance be at the Expence of the respective Towns where whose reside and are settled: Provided however, That the respective Town-Councils may bind out such Children as Apprentices, or otherwise provide for their Support and Maintenance, at any Times after they arrive to the Age of One Year, and before their arrive to their respective Ages of Twenty-one, if Males, and Eighteen, if Females.

And whereas it the earnest Desire of this Assembly, that such Children be educated in the Principles of Morality and Religion, and instructed in Reading, Writing and Arithmetic: Be it further Enacted by the Authority aforesaid, That due and adequate Satisfaction be made as aforesaid for such Education and Instruction. And for ascertaining the Allowance for such support and Maintenance, Education and Instruction, the respective Town-Councils are hereby required to adjust and settle the Accounts in this Behalf from Time to Time, as the same shall be exhibited to them: Which Settlement so made shall be final; and the respective Towns by Virtue thereof shall become liable to pay the Sums therein Specified and allowed.

And be it further enacted by the Authority aforesaid, That all Persons held in Servitude or Slavery, who shall be hereafter emancipated by those who claim them, shall be Supported as other Paupers, and not at the separate Expense of the Claimants, if they become chargeable; provided they shall be between the Ages of Twenty-one Years, if Males, and Eighteen Years, if Females, and Forty Years, and are of sound Body and Mind; which Shall be judged of, and determined by the Town-Councils aforesaid.

Ley que Autoriza a la Manumisión de Negros, Mulatos y Otros y para la Abolición gradual de la Esclavitud

Considerando que todos los Hombres tienen derecho a la Vida, a la Libertad y a la Búsqueda de la Felicidad, y que sin embargo, el mantenimiento de la Humanidad en una Condición de Esclavitud, como Propiedad privada, al que se ha llegado de manera paulatina mediante la Costumbre irrestricta y el Consentimiento de la Leyes, resulta repulsivo a este Principio, y Subvierte la Felicidad de la Humanidad, el gran Objetivo de todos los Gobiernos civiles:

Queda por lo tanto promulgado por esta Asamblea General y por la Autoridad de la misma es por lo tanto promulgado, que ninguna Persona o Personas, ya sean Negros, Mulatos u otros, que nazca en los Límites de este Estado, en o después del Primer Día de Marzo del año de nuestro Señor de 1784, serán tenidas por o consideradas Sirvientes a Perpetuidad ni Esclavas; y que toda Servidumbre a Perpetuidad o Esclavitud de niños, nacidos según lo antedicho, a Consecuencia de la Condición de sus Madres sea, y la misma es por la presente retirada, extinguida y abolida para siempre.

Y considerando que la Humanidad requiere que los Niños declarados libre según lo antedicho permanezcan con sus Madres un Tiempo adecuado desde y tras su nacimiento; para permitir por lo tanto a quienes reclaman los Servicios de tales Madres que mantengan y auxilien a tales Niños de una Manera adecuada, queda además promulgado por la Autoridad antedicha, que tal auxilio y mantenimiento sea a costa de las Poblaciones respectivas doquiera estos residan y estén radicados; A condición no obstante, de que la Ciudad-Concejo respectiva pueda entregar en servidumbre a tales Niños como Aprendices, o de otro modo hacer provisiones para su Auxilio y Mantenimiento, en todo Momento después de que alcancen la Edad de Un Año y antes de que alcancen las Edades respectivas de Veintiún Años, si son Varones, y de Dieciocho, si son Hembras.

Y considerando el más honesto Deseo de esta Asamblea, que tales Niños sean educados en los Principios de la Moralidad y de la Religión, e instruidos en Lectura, Escritura y Aritmética: Queda además promulgado por la Autoridad antedicha, Que debe otorgarse Satisfacción debida y adecuada según lo antedicho para tal Educación e Instrucción. Y para hacer efectivo el Estipendio para tal auxilio y Mantenimiento, Educación e Instrucción, se exige por la presente a la Ciudad-Concejo respectiva que ajuste y liquide las Cuentas a este Respecto de Vez en Cuando y que las mismas les sean mostradas: Cuya Liquidación se hará definitiva; y las Poblaciones respectivas, en virtud de la misma, serán responsables de pagar los Importes Especificados en las mismas y librados.

Y queda además promulgado por la Autoridad antedicha, que toda Persona tenida en Servidumbre o Esclavitud, que sea en adelante emancipada por quienes les reclaman, deberá ser Auxiliada como otros Indigentes, y no a Costa de manera separada de los Demandantes, si suponen un coste; a condición de que estén entres las Edades de Veintiún Años, si son Varones, y de Dieciocho, si son Hembras, y los Cuarenta Años, y estén sanos de Cuerpo y Mente; lo que será Dictaminado, y determinado por la antedicha Ciudad-Concejo.
